1. Preamble

 

These General Terms govern the sale of products by Sevira Kids to its customers in metropolitan France, DOM/TOM, Europe and Monde.The Customer is clearly informed and recognises that the website is aimed at consumers and that Professionals must contact the Commercial Service of Sevira Kids in order to benefit from separate contractual conditions.

 

These CGVs are referenced at the bottom of each page of the website through a link and must be read carefully and accepted by the Customer before making an order.


By clicking on the first button to place the order and then on the second to confirm the said order, the Customer admits to having read, understood and accepted the Terms and Conditions without limitation or condition.

 

Sevira Kids reserves the right to modify/update these CGVs which is why it is recommended to consult them before any new orders.

 

2. Purchase products on the website

 

2.1 Customer Information

 

In order to purchase a Product, the Customer must be at least 18 years old and have the legal capacity or, if he is a minor, be able to justify the agreement of his legal representatives. The Customer will be asked to provide identifying information by completing the form available on the website. The sign indicates the required fields that must be filled in for the Customer's order to be processed by Sevira Kids. The customer can check on the site the status of his order. Delivery tracking can be done using some carriers' online tracking tools. Customers can also contact Sevira Kids' sales department at any time by email, at the [email protected], for information on the status of their order. The information the Customer provides to Sevira Kids during an order must be complete, accurate and up-to-date. Sevira Kids reserves the right to ask the Customer to confirm, by any appropriate means, his identity, his eligibility and the information provided.


 

2.2 Product Characteristics

 

The Customer undertakes to read this information carefully before ordering on the site.

Sevira Kids undertakes to present the essential features of the products (on the fact sheets available on the site) and the mandatory information that the Customer must receive under applicable law (in these Terms and Conditions).

The items sold are described and presented with the utmost precision, however the photos are non-binding, in the sense that minimal finishing differences can occur (wire colours, hems, eds, etc.), especially due to the availability of raw materials, or modifications made by a supplier.

If, despite our precautions, a difference of this type occurred (aesthetic change that did not affect the safety of the product or its main use), Sevira Kids could not be hired for this fact.

In the interest of continuous improvement and following the feedback of the Parents, other changes can be made to our Collections (modification of a home system or the composition of a closure, etc.).

Sevira Kids cannot be held responsible for the differences inherent in the support used in the ordering process, which may affect the perception of our visuals (luminosity, etc.).

It is specified that for textile products, given the technical constraints associated with the sewing and finishing process, a difference of 2 to 3 cm can be found, without affecting the intrinsic characteristics of the product.

Given the health situation (COVID-19), the customer now has 30 days (instead of 14), from the receipt of our items, to ensure the compatibility of the product or products purchased (in the case of a birth list) with the equipment with which their use is intended (cosy, stroller, bed, cradle, pram...), without exceeding the scope of the "test", in which case the product would no longer be new and therefore no longer eligible for a return. After this date and if the article shows signs of wear and tear, no commercial gesture or return can be attributed.

2.3 Ordering Procedure


Unless otherwise stated on the site, all products sold by Sevira Kids are new and comply with current EU legislation and applicable standards in France.

Except in special cases or in exceptional cases, product orders are placed directly on the site www.sevirakids.com by the Customer.

 

Orders are done in several stages:

 

1.0 Pre-order or product reservation

 

As part of a pre-order on the site, the Customer has the option to make a request to book products of their choice within the limit of the available stock. His request is in the Contact Us section or by sending an email [email protected] The reserved product will be/will be set aside for the Customer for 3 consecutive weeks. After this time, the booking will be automatically cancelled. It is the next step to meet the 3-week deadline before pre-ordering. No unsettled orders will be shipped. Under no circumstances does pre-ordering or booking products translate into order shipping. The desired merchandise is only reserved until the day the customer orders on the site.

 

1.1 Selecting products and purchase options

 

Customers will have to select the product of their choice by clicking on the product in question and making sure to choose the characteristics (color, size, etc.) and the desired quantities. Each selected product is placed in the Customer's basket.

 

2. Validating the basket

 

Once the product (s) is selected and placed in their shopping cart, the customer must click on the basket and verify that the contents of their order are correct. If the Customer has not yet done so, he will then be asked to identify himself or register. Once the Customer has validated the contents of the basket and has identified/registered, an automatically completed online form will be displayed and summarizing the price, applicable taxes and, if applicable, delivery fees. Customers are asked to check the contents of their order (including the quantity, features and references of the products ordered, the billing address, the payment method and the price) before validating their shopping cart.


Before the basket is validated, the customer is informed of his right to register in the list of opposition to telephone canvassing as dictated by article L. 223-2 of the Consumer Code.

The Customer can then proceed to pay for the products according to the instructions on the site and provide all the information necessary for billing and delivery.

Sevira Kids cannot be held liable in any case in the event of non-performance or poor performance of contractual obligations attributable to the Customer, particularly when entering its order.

 

3. Accused of Receiving

 

Once all the steps described above are completed, a page appears on the SITE to acknowledge receipt of the Customer's order. A copy of the acknowledgement of the order is automatically sent to the Customer by email, provided that the email address provided through the registration form is correct.

 

4. Billing

 

During the ordering process, the Customer will be required to enter the information necessary for the billing (the asterisk will indicate the required fields to be filled out for the Customer's order to be processed by the Sevira Kids). In particular, the Customer must clearly state all the information relating to the delivery, in particular the exact address, as well as any possible access code to the address indicated. The Customer will then have to specify the payment method chosen. Neither the order order that the Customer establishes online, nor the acknowledgement of the order that Sevira Kids sends to the Customer by e-mail constitutes an invoice. Regardless of the method of ordering or payment used, the Customer will receive the purchase order upon delivery of the products, inside the package. Sevira Kids does not send order confirmation by mail or fax. The invoice is available and downloadable via My Account and can be sent by email to the customer's request.



 

2.4 Order Date

 

The date of the order is the date on which Sevira Kids acknowledges receipt of the order online. The deadlines indicated on the site do not start running until that date.

 

2.5. Order price

 

For all products, the Customer will find on the website prices displayed in euros all taxes included, as well as the applicable delivery costs (depending on the weight of the parcel, the delivery address, the carrier or the mode of transport chosen). Prices include value-added tax (VAT) in particular at the rate in effect on the order date. Any change in the applicable rate may affect the price of products from the date the new rate comes into effect. The applicable VAT rate is expressed as a percentage of the value of the product sold. Prices set by Sevira Kids may be changed in the event of special offers or sales. Price differences between similar models can be explained by the cost of raw materials or the state of stocks (end of series for example). 




The prices listed on the Online Store are valid, unless there is a glaring error.
The applicable price listed on the  www.sevirakids.com website has no correlation with that established on the sites of Market Place partners or resellers.

 

Special cases of the prices mentioned on social networks:

The prices mentioned on social networks are given as an indication and generally correspond to specific transactions (soldiers, exceptional promotions, etc.). They have no contractual value. Thus, Sevira Kids could not be committed to charging a product at the price mentioned on an old publication on all social networks or market places,nor at the prices mentioned in its Facebook, Instagram and Pinterest stores that may incur a slight delay of computer update due - among other things - to the processing times of the social network. 

 

2.6. Product availability

 

Offers of products sold by Sevira Kids are valid within the limit of available stocks.

The unavailability of a product is in principle indicated on the page of the product concerned with the word "More stock". The Customer may also be informed of the restocking of a product by contacting Sevira Kids.In any event, if the unavailability was not indicated at the time of the order, Sevira Kids undertakes to inform the Customer without delay of the unavailability of the product. Sevira Kids can, at the customer's request:



  • Either partially shipping the available products first and then shipping the rest of the order when the other products are available, subject to clear information about the additional transportation costs that could be incurred,
  • Either offer an alternative product of equivalent quality and price, accepted by the Customer.

If the Customer decides to cancel his unavailable product order, he will get a refund of all the sums paid for the last one (s) as soon as possible, within a maximum of thirty (30) days after payment.

 

 

3. Payment

 

3.1. WAYS TO PAY


Customers can pay for their products online on the secure website and Sevira Kids, which can be paid for by bank card, PayPal, transfer, cheque or Amazon Payments. It should be noted that for a transfer or cheque payment, the processing time will be longer than for other options. By making their choice, the Customer assures Sevira Kids that it has all the necessary permissions to use the chosen payment method. Sevira Kids takes all necessary measures to ensure the security and confidentiality of data transmitted online as part of the secure online payment on its website https://www.sevirakids.comIl is the followingly specified that all payment information provided on the website is transmitted to the site's bank and is not processed on



www.sevirakids.com.

 

Gift card

Sevira Kids gift cards are exclusively electronic and can only be used throughout the SeviraKids.com store. They have a validity period of 6 months from the date of its issuance. The Customer has 14 days from receipt (the right of withdrawal).

 

As soon as you use, purchases are deducted from the gift card balance. If a purchase from the Customer exceeds the amount of the balance available to the card, the remainder or "remains" will have to be paid by an additional means of payment.

 

If an order has been paid for entirely by gift card, we will not be able to make a refund on the gift card. If an order has been paid with a gift card in addition to another form of payment, we will only refund the amount paid by each payment method initially used.

 

The card cannot be replaced or refunded in case of loss or theft.

 

3.2. PAYMENT DATE


In the case of a single payment by credit card, the Customer's account will be debited to order.

 

Payment times via PayPal or transfer may vary depending on your bank. For cheques, they are deposited as soon as they are received and the goods sent after cashing.

3.3. DELAY OR REFUSAL OF PAYMENT


If the bank refuses to charge a card or other means of payment, the Customer will have to contact Sevira Kids Customer Service to pay for the order through any other valid payment method.

We inform you that no orders that have not been completed will be prepared and shipped.

In no way is Sevira Kids responsible for refusing payment. In the event that, for whatever reason, opposition, refusal or otherwise, the transmission of the flow of money due by the Customer proves impossible, the order will be cancelled and the sale automatically terminated.

 

3.4. TRANSFER OF OWNERSHIP

 

The Seller reserves ownership of the products delivered until the full payment of their price.

 

4. Cancellation or change of order

 

Customers can request the cancellation or partial modification of their order if it has not yet been shipped.

 

In the event of a complete cancellation of the unsurred order, the Seller agrees to refund the entire order, including the port costs. The case of a shipment made falls within the conditions of the right of withdrawal or return mentioned below.

 

Port fees cannot be waived even if the order is partially cancelled.

 

5. PACKING

 

The products will be packaged in accordance with current transport standards, to ensure maximum protection during delivery. Customers are committed to the same standards when returning products under the above conditions.

 

Special case: Gift wrapping

The Customer has the option to choose the "gift wrapping" option. This option generates an additional cost specified at the basket validation stage. The Customer's order will be wrapped in traditional gift paper accompanied by a gift card/gift message, a small accessory gift or additional decorative element, such as a fabric heart or a pair of anti/birth scratch mittens.

The choice of the "gift wrapping" option implies that the invoice will not be attached to the package. The invoice will be available by default in My Account or sent by email at the Customer's request.

 

6. DELIVERY

 

The delivery terms of the products are included in the "Delivery Policy" below.

6.1 SHIPPING TIMES

 

Generally, from experience, the Sevira Kids team handles and mail orders received before 2 p.m. on the same day they are received. Otherwise, their treatment is done the next day.

These deadlines are defined as non-weekends or public holidays, orders received during these days will be processed the following working day.

 

The preparation of the order is triggered when the payment is received. The Seller reserves, however, the right to prepare the order within 48 hours of receiving the payment.

 

COVID-19: Delivery times and online tracking are impacted during the COVID-19 health crisis, all carriers and all modes of delivery combined. Thank you for your kindness and understanding on this subject. In this context of exceptional health crisis, logistics companies have very strict guidelines to follow in order to protect their health but also those of the customers they deliver. In the context of home deliveries, government guidelines state that delivery drivers must not enter the enclosures of their clients' homes or buildings, nor therefore elevators.

 

During the ordering process on the online store, Sevira Kids tells the customer the possible shipping times and formulas for the products purchased. The delivery provider is therefore specified (La Poste (Colissimo) or DHL) as well as the indicative delivery time.


Shipping costs are calculated based on the chosen delivery method, the volume of the items and the destination. The amount of these costs will be owed by the Customer in addition to the amount of products purchased.

 

 

EXPRESS DELIVERY:

Orders noted in express delivery are processed as a priority and delivered according to the posted time frame, excluding exceptional situations: the next day. This applies to all orders received before 3 p.m.

 

For all orders received after 3 p.m., they will be processed only on the next working day.

Example: An order made on Friday at 4 p.m. will be shipped the following Monday and delivered the next day.

An order made on Monday at 10am will be shipped in the evening and delivered the next day (Tuesday).

 

CASE PARTICULIER: Delivery of bulky items: EUR 7.90 additional costs for handling and home delivery of non-size classic items such as cradles, furniture, etc.

 

An e-mail message will be automatically sent to the Customer at the time of shipping of their order, provided that the email address in the registration form is correct.

6.2 ORDER RECEPTION

 

As carriers are independent service providers of our company, in case of damage or missing, oral reservations (even confirmed by letter), as well as the word "accepted subject to control" on the delivery order, are unfortunately of no legal value. Delivery drivers are not required to deliver upstairs even if there is an elevator. Thus, the parcel or pallet will be deposited at the foot of your building or in front of your home. The parcel can be delivered to the Customer in his mailbox, by hand or to the Guardian, at the delivery address indicated during the ordering process. The delivery concludes the transfer of ownership.


In the case of large parcels and in the absence of the Customer, a notice of passage will be deposited in the mailbox, specifying the address and the time of availability of the parcel.6.3 RETARDS, VOLS OR AVARIESIt is specified that shipments are made - unless otherwise informed - within 24 to 72 hours from metropolitan France, and that deliveries will be made within fifteen (15) days maximum. Failing that, the Customer must notify Sevira Kids to deliver within a reasonable time and if not delivered within that time, he will be able to terminate the contract. Sevira Kids is responsible until the product is delivered to the Customer (including delivery in a mailbox, by hand or to the Guardian). It is recalled that the Customer has three (3) days to notify the damage or losses observed during the delivery.




 

THE CUSTOMER WHO HAS NOT RECEIVED THE PACKAGE MUST PREVENT SEVIRA KIDS AND MAKE THE CLAIM OF NON-RECEPTION OF HIS COLISS AFTER THE CARRIER CONCERNS BEFORE ANY CONTACT.

 

6.4 CLAIM FOR REIMBURSEMENT FOR LOSS, THEFT OR DAMAGE

 

In the case of a loss of parcels proven during distribution and after investigation by the Carrier, Sevira Kids will reimburse the Customer, without excessive delay from the receipt of the certificate on the dated and signed honor indicating the non-receipt of the parcel, the total amount paid for the products, taxes and delivery costs included, by means of the same method of payment used by the Customer to purchase the Products.

 

Special case: In the event that the Customer has not received the package when it is marked "delivered" on the carrier's website, the Customer must send an e-mail certificate of honour indicating that the package is not received so that Sevira Kids can make a claim with the carrier.

As Sevira Kids is not responsible for the thefts or damage to the Customer's mailbox, the decision will come after the result of the investigation conducted by the carrier. Any certified package delivered by the Carrier after investigation will not be subject to compensation/refund or return of goods.

 

6.5 REQUEST FOR REMOVAL

 

In case the customer wishes to return his parcel, Sevira Kids will make the return of the Customer's order as desired, after receiving the certificate on the honor indicating the non-reception of the package.

 

 

7. Right of Withdrawal and Right of Return

 

7.1 Withdrawal right applicable to consumer customer

 

All Articles may be retracted, except those excluded by law under Article L221-28 of the Consumer Code and specified in Clause 7.4 Exclusion of the Right of Withdrawal.

 

For example: items that have been customised on your application, items have been unsealed, items cannot be returned for hygiene reasons (e.g. socks worn), etc.

 

The customer has 14 days, from the receipt of our items, to ensure the compatibility of the product or products purchased (in the case of a birth list) with the equipment with which their use is intended (cosy, stroller, bed, cradle, pram...), without exceeding the scope of the "test", in which case the product would no longer be new and therefore no longer eligible for a return.

After this date and if the article shows signs of wear and tear, no commercial gesture or return can be attributed.

 

The Customer may be liable if he performs manipulations other than those necessary or if the returned product contains dust, hair, stains, fingerprints and other residue that makes the resale of the property impossible.

 

Subject to the provisions of clause 7.2 below, the Client has the legal 14-day retraction period to exercise his right of withdrawal without having to justify reasons or pay penalties, except for the return fee. The return costs are the responsibility of the Customer.

 

7.2 Principle of RetractionThe Client has, as a matter of principle, the right to return the PRODUIT to the VENDEUR or to a person designated by the latter, without excessive delay, and no later than fourteen (14) days after the disclosure of his decision to recant, unless the VENDEUR proposes to recover the PRODUIT himself.

 

7.3 Withdrawal periodThe withdrawal period expires fourteen (14) calendar days after the day the Customer, or a third party other than the carrier and designated by the Customer, physically takes possession of the PRODUIT. In the event that the Customer has ordered several PRODUITS via a single order resulting in multiple LIVRAISONS (or in the case of an order for a single PRODUIT delivered in several batches), the withdrawal period will expire thirty (14) calendar days after the day the CLIENT, or a third party other than the carrier and designated by the Customer, physically takes possession of the last PRODUCT delivered.


 

N.B: In the event that the Customer had initially paid a shipping fee (order less than EUR 60) these will not be refunded. Gift wrapping is also non-refundable.

 

7.4 Exclusion of the right of withdrawal and right of return

 

In accordance with Article L. 221-28 of the Consumer Code,and unless expressly agreed between the Seller or the Customer, the right of withdrawal and return does not apply to all products, including:

 

- For reasons of hygiene or health protection

Slippers/socks/wake socks/tights/underwear

Accessories in the bath and care category: Thermo Bunny or TermoFoxi boilers, wipes, etc.

Cleanliness products (wc-reducing pot, wipes, etc.)

Toys or teething accessories, teething mittens and bath toys

Meal category products (spoons, plates, bowls, cups, bottles, snackers, silicone bibs, textile bibs, etc.)

Items that have been unsealed, such as toys: any toy that is detached and/or removed from its packaging will not be taken back or exchanged

Akio and INNOGIO soft silicone nightlights (likely to have been carried to the mouth by children)

 

- If they are likely to deteriorate or perish (e.g. gift cards, gift wrapping, etc.), or

- If they are made to the customer's specifications or clearly customized.

 

Furthermore, the right of return does not apply to gift cards. On the other hand, gift cards have the right of withdrawal.

 

 

7.5 Terms of implementation of the right of withdrawal and the right of return

 

Notification of the right to withdraw

 

In order to exercise his right of withdrawal or return, the Client must notify his decision to withdraw from this contract by means of an unambiguous statement before the 14-day retraction period expires.

The Seller will e-mail the Customer an acknowledgement of the retraction or information of the return of the Product(s).

 

This email includes:

- The procedure for the return or retraction of the Product(s),

- The postal address to which the Customer must return the product or products

- A summary of the registered products

 

The retraction form is available here or can be emailed on request. The return voucher is not required to be attached in the return package.

 

 

Return address

The Customer will have to, without excessive delay and, in any event, no later than thirty (14) days after communication of his decision to withdraw from this contract, return the property, to: Sevira Kids, 28 rue Notre-Dame de Bon Secours, 60200 Compiègne, France

 

 

Effects of withdrawal - Refund

As long as the Customer receives the return in accordance with the conditions previously mentioned above:

- If the customer wishes to return the entire order, he will be credited with the amount indicated on the confirmation of order excluding delivery charges made.

- If it returns a portion of the products ordered, it will be credited with the amount corresponding to the returned product.

 

The refund will be made no later than 14 days after receiving return goods subject to the request for return or withdrawal from the day of receipt by the Seller.

 

The refund will be made by the same means of payment as the one used by the Customer to pay his order. The product must be returned in good condition, in its original packaging and with all of its accessories.

 

Any damaged returned product and/or out of its original packaging and/or without all of its accessories will not be subject to a refund.

In case of return of returned products(s) do not comply with the conditions of return, it will be (s) returned to the customer.

 

The Seller reserves the right to refuse the refund for the following costs:

 

- Return costs

- Delivery costs

- Gift wrapping

 

7.6 Exchange

 

DELAIS AND CONDITIONS


If the Customer wishes to change a product (color, model or size), he must inform the Seller before any return. The return costs remain at the Customer's expense.

 

If the desired product is priced higher than the price originally paid, the Customer must make a payment of the difference. Upon receipt of the item, Sevira Kids will send the new item.

 

The item (s) sent as a gift to the recipient by the invoiced, can be refunded only on the initial account used when paying the order. By default, the recipient of the gift has the right of withdrawal, within 14 days of the delivery date to the terms previously described.

 

The terms and conditions are identical to those mentioned in our return conditions (the deadlines, the types of products accepted for the return...)

 

The desired product for the exchange will be/will be returned to the Customer at the Seller's expense.

In accordance with the Act, the right of withdrawal does not apply to purchases made in the Fair or Fair Framework.

Consumers and Customers are informed about the absence of a right of withdrawal.

In order to best satisfy its Customers and according to certain specific criteria, Sevira Kids may consent to an exchange in return for the Client's assumption with the same exchange conditions mentioned above.

 

N.B.: Sevira Kids does not make any hand-exchanges outside of Exhibition Fairs or Fairs.

 

7.8 Claims related to post-washing damage We take great care in the manufacture of our products and recommend that our customers follow the washing and spin instructions of our Textile Collections: - machine washing at low temperature- low spin - no tumble dryer In order to preserve the durability of the textile, It is best to wash Baby's laundry separately and/or use wash bags if possible so that Velcro strips or other items such as zippers, etc. do not damage your laundry.



Any textile damage that occurs after washing - apart from a possible glaring manufacturing defect - will not be subject to any compensation.

 

Similarly, as with any physical shop, no claims that occur several weeks or months of use will be subject to any compensation, as the conditions of use and or washing cannot be verified by the Seller. This clause includes products in the textile, meal, hygiene and care category involving heavy use and repeated washing.

 

8. Guarantees

 

8.1 Consumer Customer-Specific Stipulations

 

Sevira Kids Products benefit from the existing legal guarantees, namely, the legal guarantee of compliance (Articles L. 217-4 to L.217-13 of the Consumer Code) and the legal guarantee of hidden defects (Articles 1641 and 1648). If, despite the care taken on each order, all or part of the order arrives deteriorated or with a missing part, it is enough for the Customer to report it to the Customer Service of Sevira Kids by email at the address [email protected]

 

You have a legal period of 14 days from the receipt of your order to notify us of any defects and benefit from an exchange or refund.

 

Sevira Kids is required to deliver a compliant product that is specific to the expected use of a similar property and corresponding to the description given on its website. This compliance also assumes that the product has the qualities that a buyer can legitimately expect in relation to public statements made by the brand, including in advertisements and labelling. In this context, Sevira Kids is likely to be responsible for existing compliance defects in the issuance and non-compliance resulting from the packaging, assembly instructions or installation when it has been placed in its care or has been carried out under its responsibility. Compliance guarantee

 

Article L.217-4 of the Consumer Code

The seller delivers a property in accordance with the contract and responds to any compliance defects that exist at the time of issuance.

It also addresses compliance defects resulting from the packaging, assembly instructions or installation when it has been placed in its care by the contract or has been carried out under its responsibility.

 

Article L217-5 of the Consumer Code

The property complies with the contract:

(1) If it is suitable for the usually expected use of a similar property and, if so:

- if it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model;

- if it presents the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, especially in advertising or labelling;

(2) Or if it has the characteristics defined by the parties or is specific to any special use sought by the buyer, brought to the seller's knowledge and which the seller has accepted.

 

Article L217-9 of the Consumer Code

 

In the event of a non-compliance, the buyer chooses between repairing and replacing the property.

However, the seller may not proceed according to the buyer's choice if the choice results in a clearly disproportionate cost under the other modality, given the value of the property or the size of the defect. It is then obliged to proceed, unless impossible, according to the method not chosen by the buyer.

 

Article L217-11 of the Consumer Code

 

The provisions of Sections L. 217-9 and L. 217-10 are applied at no cost to the purchaser.

These same provisions do not impede the allocation of damages.

 

Article L217-12 of the Consumer Code

 

The action resulting from the non-compliance is prescribed by two years from the issuance of the property.

 

For the application of the 4th, 5th and 6th of Article L. 111-1, we inform you that: (3) If necessary, the existence and procedures of exercise of the legal guarantee of compliance mentioned in Articles  L. 217-4 to L. 217-13 and the defects of the thing sold under the terms of articles 1641 to 1648 and 2232 of the Civil Code and, if applicable, the commercial warranty and after-sales service mentioned respectively in articles  L. 217-15 and  L. 217-17;   [...]

When the CGV was accepted, the Client also confirms the reading of the legal provisions (compulsorily posted under Article  L.242-16 of the Consumer Code) provided for in Articles  L. 221-5, L. 221-6, L. 221-8,  L. 221-11,  L. 221-12 to L. 221-14.

 

 

8.2 Hidden Defects Guarantee

 

You may decide to implement the warranty against the hidden defects of the thing sold within the meaning of section 1641 of the Civil Code. In this case, you can choose between resolving the sale or reducing the sale price in accordance with Section 1644 of the Civil Code.

 

Article 1641 of the Civil Code­

The seller is bound by the guarantee because of the hidden defects of the thing sold which make it unsuitable for the purpose to which it is intended, or which diminish this use so much, that the buyer would not have acquired it, or would have given only a lower price, if he had known them.

 

Article 1648 paragraph 1er of the Civil Code

The action resulting from the defects must be brought by the Client within two years of the discovery of the defect.

 

8.3 Stipulations specific to Professional Customers

 

Business customers will not be able to benefit from the legal compliance guarantee of articles L. 221-4 under the Consumer Code. In addition, they can benefit from the legal guarantee of hidden defects stipulated in Articles 1641 of the Civil Code.

 

 

9. Responsibility and “Force Majeure”

 

Sevira Kids cannot be held responsible, or considered to have failed here, for any delay or non-performance, where the cause of the delay or non-performance is related to a case of force majeure as defined by the jurisprudence of the French courts and courts. It is further specified that Sevira Kids does not control websites that are directly or indirectly linked to the website. Accordingly, it excludes liability for the information published there. Links to third-party websites are provided only as an indication and no guarantees are provided as to their content.

 

 

10. Personal data

 

10.1 Evidence and archiving

 

Sevira Kids agrees to archive this information to track transactions and produce a copy of the contract at the client's request. However, Sevira Kids recommends that customers keep a reliable paper or computer track, any data related to their orders.

 

Any contract with the Customer for an order of 120 euros or more TTC will be archived by Sevira Kids for a period of ten (10) years in accordance with Article L. 213-1 of the Consumer Code. The Seller guarantees access to the Customer at all times.

12. Validity and Change of Terms and Conditions

 

Any change in the law or regulations in force, or any decision by a competent court invalidating one or more clauses of these Terms and Conditions, cannot affect the validity of these Terms and Conditions. Such an amendment or decision does not in any way authorize Customers to ignore these Terms and Conditions.

 

All conditions not expressly addressed here, will be governed in accordance with the use of the retail sector for companies headquartered in France.

 

These Terms and Conditions apply to all purchases made online on the website, as long as the site is available online.

 

Terms and conditions are accurately dated and can be changed and updated by Sevira Kids at any time. The applicable terms and conditions are those in effect at the time of order.

 

Changes to the Terms and Conditions will not apply to products already purchased.

 

13. Jurisdiction and applicable law

 

These Terms and Conditions and relations between the Client and Sevira Kids are governed by French law. In the event of a dispute, only the French courts will have jurisdiction. However, prior to any recourse to the arbitral or state judge, negotiation in a spirit of loyalty and good faith will be preferred in order to reach an amicable agreement in the event of any conflict relating to this contract, including its validity. The party wishing to implement the negotiation process will have to inform the other party by recommended letter with acknowledgement indicating the elements of the dispute. If, after a period of fifteen (15) days, the parties could not reach an agreement, the dispute will be referred to the competent court designated below. Throughout the negotiation process and until its outcome, the parties prohibit themselves from taking any legal action against each other and for the conflict that is the subject of the negotiation. By exception, the parties are allowed to refer the matter to the court of the referees or to seek an order on application. A possible action before the court of the referees or the implementation of a procedure on application does not result on the part of the parties any waiver of the clause of amicable arrangement, unless expressly opposed.

PROMO CODES / DISCOUNT COUPONS / CONTEST GAME

Special offer coupons/promo codes can only be used once. They can be used on any item, even sold.

Any including offer, the welcome offer is valid only once per person and is not cumulative with other discount codes. It is only cumulative with other current promotions.
